These terms apply to your use of the TandAPI website, apps and API (the "service"), provided by TandAPI ([legal entity name, address and Chamber of Commerce number to be completed]). By creating an account or using the service you agree to them. How personal data is handled is described in the privacy policy.
What the service is, and is not
TandAPI lets clinics, medical specialists and patients upload dental panoramic X-rays (OPG), receive an AI-assisted analysis and an optional specialist opinion, and book appointments. The analysis supports screening. It is not a diagnosis and does not replace the judgement of a qualified medical professional. A normal result does not rule out a condition, and an abnormal one does not confirm it. In an emergency, contact your local emergency number.
Accounts
You must give accurate information and keep your sign-in details safe. You are responsible for what happens under your account. You must be at least 16, or have the consent of a parent or guardian.
Clinics and specialists
Clinics and specialists are independent professionals, not employees or agents of TandAPI. They are responsible for the care they give, for holding and keeping valid the registrations and qualifications they declare, and for the data they enter. A specialist's opinion is the specialist's own. Clinics pay TandAPI for their panel under the plan they choose.
Anyone can ask to register a clinic, but a clinic can only be used once TandAPI has approved it, from the documents it sends or after TandAPI has called its management. The person who registers a clinic confirms that she is entitled to act for it and that what she gives is correct. TandAPI may refuse a clinic, or suspend one whose details turn out to be wrong.
Appointments and payments
An appointment is an agreement between you and the clinic. Any deposit, price and cancellation terms are set by the clinic and shown to you before you confirm; a deposit is deducted from the price of the service if you attend, and a cancellation fee, if the clinic sets one, is taken from it. Payments are processed by the payment provider of the clinic. TandAPI is not a party to that payment and takes no fee from it.
Acceptable use
Do not upload anything you have no right to share, anything unlawful, or images of people who have not agreed to it. Do not try to access data that is not yours, probe or disrupt the service, resell it without our agreement, or use the API beyond its limits.
Intellectual property
TandAPI and its content, software and brand belong to TandAPI or its licensors. You keep the rights to what you upload and give us the right to process it as needed to provide the service you ask for.
Availability and changes
We work to keep the service available but do not promise it will be uninterrupted or error-free. We may change or end features, and we will give notice of changes that matter to you.
Liability
Nothing in these terms limits liability that cannot be limited by law, including for intent or gross negligence. Subject to that, TandAPI is not liable for decisions made on the basis of an analysis or an opinion, or for indirect loss. [Limits of liability to be confirmed with counsel.]
Ending your account
You can close your account at any time from your settings. We may suspend or close an account that breaks these terms or puts others at risk.
Governing law
Dutch law applies. Disputes go to the competent court in the Netherlands, without affecting any mandatory consumer rights you have in your country of residence.
